1. Purpose

These Terms and Conditions (“Terms”) govern access to and use of the dryseason.studio website and the applications published by Dry Season Studio (trade name of the sole proprietorship of Fabien Bavent, SIREN 878 451 723), including Cairn, Horizon, and Perennial. Using the site or an app constitutes full acceptance of these Terms.

2. Access to the service

The site and apps are accessible to anyone, with no age restriction, subject to the terms of use of the App Store and Google Play, particularly regarding purchases and user accounts.

3. Purchases and premium features

Some apps, including Perennial, offer premium features available through native in-app purchases (Apple In-App Purchase, Google Play Billing). These transactions are made directly with Apple or Google, who act as the seller. The sales, billing, and refund terms of these platforms apply in full, including for refund requests.

4. License to use

Using an app grants a personal, non-exclusive, non-transferable, revocable license for private, non-commercial use consistent with its intended purpose.

5. Cross-app connection feature

Perennial offers an optional feature to connect your apps, based on a technical identifier tied to your device. This feature is provided “as is” and may be interrupted or modified. See our privacy policy for details on the data involved.

6. Intellectual property

The site, the apps, their content, design, and code remain the exclusive property of Dry Season Studio. No license or right other than those expressly granted under these Terms or the distribution platforms’ terms is granted.

7. Liability

We strive to provide reliable, tested, and maintained software. The studio cannot be held liable for indirect damages, data loss, or service interruptions related to the use of its apps, to the extent permitted by applicable law.

8. Changes to these Terms

These Terms may be updated at any time. The version in effect is the one published on this page, along with its update date.

9. Governing law

These Terms are governed by French law. If you reside in the European Union or elsewhere, the mandatory consumer protection provisions of your country of residence remain applicable, where relevant, in addition to these Terms.
